The arch of triumph at the entrance to the upper town has been an inexhaustible subject of controversy for many generations of antiquaries, and up to the time of Dunod was generally attributed to Aurelian: that historian, however, believed that its sculptures represented the education of Crispus, the son of Constantine, and that the name Chrysopolis, by which Besançon was very generally known in early times, was only a corruption of Crispopolis.
The Jesuit Dunod relates that the amphitheatre was to be seen at the beginning of the seventeenth century, in the ruined state in which the Alans and Vandals had left it after their successful siege in 406. It seems to have stood near the present site of the Madeleine.
"Prescription," says Dunod, "seems repugnant to natural equity, which permits no one either to deprive another of his possessions without his knowledge and consent, or to enrich himself at another's expense.
