I, that the plea of antefort acquit was no bar to the prosecution of an appeal, would not apply in this instance, as that statute was limited to cases of homicide. Fairfax was moreover a man for whom the king had a high personal regard. At the August assizes there had been an effort to show that the children were "counterfeiting." See the Discourse, 235-237.
II, provides that indictments shall be proceeded in, immediately, at the king's suit, for the death of a man, without waiting for bringing an appeal; and that the plea of antefort acquit in an indictment shall be no bar to the prosecuting of an appeal. This law was passed to get around special legal inconvenience and related only to homicide and to the single case of prosecution by appeal.
