Ein Teil der Litteratur bezieht 1 Vict. c. 88 s. 3 nicht auf die piracy iuris gentium, sodass durch das Gesetz zwar die bisherige Strafe aufgehoben, aber keine neue bestimmt wäre (so Stephen, Digest of the criminal law 6. April 1790 und in allen späteren Bestimmungen über piracy angedrohte Todesstrafe ist durch die Akte vom 15. Januar 1897 beseitigt.
