Die „offences against the law of nations“ als Verletzungen solcher Anordnungen des Landesrechts, die sich zugleich als Bestandteil des Völkerrechtes darstellen , unterliegen der Ahndung seitens jedes Staates, in dessen Gebiet der Täter betroffen wird.
Zu diesen offences against the law of nations wird auch die piracy gezählt ; aber es ist nicht zu übersehen, daß sie unter ihnen eine durchaus eigenartige Stellung einnimmt.
Er wird nunmehr aus einer angeblichen völkerrechtlichen Notwendigkeit abgeleitet; eine Betätigung der Staatsgewalt außerhalb des Territoriums und ohne personale Beziehung soll dem internationalen Rechte zuwiderlaufen. II. Offences against the law of nations; piracy.
