The former is the more simple and obvious, though it must be confessed that the latter is favored by the usus loquendi of T., in regard especially to secretum, cf. 39; Ann. 3, 8, where secreto is opposed to palam; and His. 4, 49: incertum, quoniam secreto eorum nemo adfuit.

And so also the vigorous narrative of the old commentator concerning Pope Nicholas III. is deprived of its most telling points: "Nam fuit primus in cujus curia palam committeretur Simonia per suos attinentes. Quapropter multum ditavit eos possessionibus, pecuniis et castellis, super onmes Romanos": "For he was the first at whose court Simony was openly committed in favor of his adherents.

For, among many other things which he performed in the General Assembly of the States, it follows: "Post haec autem palam se errasse confessus, et imitatus Imperatoris Theodosii exemplum, poenitentiam spontaneam suscepit, tarn de his, quam quae in Bernardum proprium nepotem gesserat": "After this he did openly confess himself to have erred, and following the example of the Emperor Theodosius, he underwent voluntary penance, as well for his other offences, as for that which he had done against Bernard his own nephew."

Luxury The following verses, excellent in matter and form, belong to the adaptation of the -Phoenix- of Euripides: -Sed virum virtute vera vivere animatum addecet, Fortiterque innoxium vocare adversum adversarios.

He appoints Brithnoth first abbot, and assigns certain lands and revenues, including ten thousand eels due to him as king, for the maintenance of the monastery. To signify the public character of the grant, it is stated in the attestation clause that it is made not in a corner, but in the open: "Non clam in angulo sed sub divo palam evidentissime." This was in the year 970.

Besides the "severa paupertas" of Camillus and Fabricius, he had something of their primitive integrity; and he declined, with scorn, to be an accomplice in the proposed assassination of Arminius: "non fraude neque occultis, sed palam et armatum, Populum Romanum hostes suos ulcisci." He protected magistrates and poor suitors, against the nobles.
