The consequence is that the liberties of the people who are judged are given into the hands of those who are supposed to be their natural judges, like parishioners into the hands of their pastor, so that the people belong to the magistrates as an inheritance, while the litigants exist for the sake of the judge, and not the judge for the sake of the litigants.

It was an exceeding brave one; most of the old and honored families being at it, so that the great house wherein my uncle lives was much crowded. Among them were Governor Broadstreet and many of the honorable Magistrates, with Mr. Saltonstall and his worthy lady; Mr. Richardson, the Newbury minister, joining the twain in marriage, in a very solemn and feeling manner.

According to the previous arrangement the magistrate immediately nominated by the people might have had a military position; the Sullan arrangement, on the other hand, reserved such a position exclusively for those magistrates whom the senate confirmed in their official authority by prolonging their term of office.

These sensible words, said without the least hesitation, and with the ease of a man who is perfectly sure of his facts, made some impression on the magistrates. "Yes, we must find all these persons and summon them," said Monsieur Mouilleron; "but it is more than the affair of a day. Make up your mind, therefore, in your own interests, to be imprisoned in the Palais."

The old frame of constitution went on as usual; there was still a Senate, still consuls, and all the other magistrates, but Cæsar Octavianus had the power belonging to each gathered in one.

By the influence of the magistrates, and of the sacerdotal order, a great number of dutiful addresses were obtained, particularly from the cities of Nicomedia, Antioch, and Tyre, which artfully represented the well-known intentions of the court as the general sense of the people; solicited the emperor to consult the laws of justice rather than the dictates of his clemency; expressed their abhorrence of the Christians, and humbly prayed that those impious sectaries might at least be excluded from the limits of their respective territories.

A similar watch was already kept upon the house where investigating magistrate Amadieu resided. And if the latter's life was precious, that of Public Prosecutor Lehmann was equally so, for he was one of those political magistrates, one of those shrewd talented Israelites, who make their way in very honest fashion by invariably taking the part of the Government in office.

But, unfortunately for me, the Colonel was at Mansfield, in attendance at the Assizes he being one of the County Magistrates. I did not however lose the object of my visit, as every attention was paid in showing me about the premises.

Their retreat was discovered by the boy, who, having noticed the procession of lights in the darkness, became convinced that the Spaniards had retired, and persuaded the magistrates to allow him to make his way out to the fort to reconnoitre. As soon as the truth was known the fleet advanced, passed the fort, and drew up alongside the quays.

For a series of years after his arrival, he had contrived to evade taking the customary oaths of allegiance; but this, eventually awakening the suspicions of the magistracy, brought him more immediately under their surveillance, when, year after year, he was compelled to a renewal of the oath, for the imposition of which, it was thought, he owed more than one of those magistrates a grudge.
