In deciding the railroad cases the courts applied the same general principles, the public nature of the railroad business having already been established by a decision in 1872.* Another point was involved, however, because of the contention of the attorneys for the companies that the railway charters were contracts and that the enforcement of the laws would amount to an impairment of contracts, which was forbidden by the Constitution.

On the mental side the general characteristics of hypnotic Somnambulism are as follows: 1. The impairment of memory in a peculiar way. In the hypnotic condition all affairs of the ordinary life are forgotten; on the other hand, after waking the events of the hypnotic condition are forgotten. Further, in any subsequent period of Hypnosis the events of the former similar periods are remembered.

It may occur in a mild form, with pain, impairment of movement, and œdema, and sometimes an elongated, fluctuating swelling, the result of serous effusion into the sheath. This condition may alternate with a gonorrhœal affection of one of the larger joints. It may subside under rest and soothing applications, but is liable to relapse.

Consumption is due principally to lowered vitality attributable to an insufficient amount of air being inhaled. The impairment of vitality renders the system open to attacks from disease germs. Imperfect breathing allows a considerable part of the lungs to remain inactive, and such portions offer an inviting field for bacilli, which invading the weakened tissue soon produce havoc.

Reason, judgment, perception, memory and understanding lose their vigor and capacity. The will becomes powerless before the strong propensity to drink. The moral sentiments and affections likewise become involved in the general impairment. Conscience, the feeling of accountability, the sense of right and wrong, all become deadened, while the passions are aroused and excited."

One additional remark I have to make with reference to the loss of power, or palsy of various muscles, which frequently follows diphtheria. Almost always there is some impairment of power in the muscles of the throat on which the deposit had taken place, and there is, in consequence, a little difficulty in swallowing for a few days.

The impairment of memory with advancing years also illustrates both "general" and "partial" Amnesia. The old man loses his memory of names, then of other words, then of events, and so gradually becomes incapable of much retention of any sort. Defects of Will Aboulia. A few words may suffice to characterize the great class of mental defects which arise on the side of action.

He had stopped scratching his scalp and pushing his strawberry-blond hair even more out of place, leaving his hands motionless and his eyes fixed on the table top. Good, he thought; at least he won't make himself bleed with all that scratching. The man adjusted his glasses, which didn't help, as his vision impairment was due to the dim lighting.

All impairment of speech is called Aphasia, and it is called Motor Aphasia when the apparatus is damaged on the side of movement. If the fibres coming out from the speech zone be impaired, so that the impulses can not go to the muscles of articulation and breathing, we have Subcortical Motor Aphasia.

We have in the darkness and light, in calm and storm, an unswerving guide. Now Columbus can steer for any new world. Does not this seem like a spiritual force? Lodestone can impart its qualities to hard steel without the impairment of its own power. There is a giving that does not impoverish, and a withholding that does not enrich. Wherever there is need there is supply.
