The citizen leaves home to go to work in the morning. A sidewalk is provided for his convenience and safety if he needs or prefers to walk. The abutters must keep it in a safe condition; open coal scuttles, heaps of sand or gravel, or other obstructions must not remain there, and in winter ice must not threaten hurt.

In the laying out of a park a landscape architect may prefer single trees and open spaces, where the neighbors and abutters prefer a grove. In the long run his taste is no better than theirs, though he may argue as if they were ignorant and uncultivated because they disagree with him.

That is, all exclusive franchises whereby rights in the streets, or other rights of the public, are given away to a corporation organized for purposes of gain. In Louisiana, street railway franchises may only be granted on petition of a majority of the abutters, and must be sold at auction for the highest percentage of gross receipts, and so substantially in South Carolina.

An argument for the restoration of the classical system of education which should run off into eulogies of the good old times might easily become an argumentum ad populum; an argument in favor of a new park which should dwell on selfish advantages which might be gained by the abutters without regard to larger municipal policy would probably be an argumentum ad hominem.

A notable limitation on the use of streets, however, we find imposed by the statutes of New York and many other States, which provide that no railway shall be placed therein without the consent of a majority of the property owners or abutters.

You have noticed how it is when a new boulevard is laid in any part of the city. There is always a dispute between the municipality and the abutters. Should the abutters be assessed for betterments or should they sue for damages? Usually both actions are instituted. The cost of such litigation should be included in the price which the community pays for the improvement.

This suit concerned a question as to the current and level of a stream of water and the necessity of removing a dam, in which dispute the administration, instigated by the abutters on the river banks, had meddled. The removal of the dam threatened the existence of Gazonal's manufactory.

His appetite for tyranny was thus balked; and to satisfy it in some way he patiently studied the laws relating to rentals and party-walls; he fathomed the jurisprudence which regulates the dwellings of Paris in an infinite number of petty questions as to tenants, abutters, liabilities, taxes, repairs, sweepings, decorations for the Fete-Dieu, waste-pipes, lighting, projections over the public way, and the neighborhood of unhealthy buildings.

The uneven character of the ground upon which Worcester is built is favorable to drainage, and advantage has been taken of this fact to construct an excellent system of sewers, which thoroughly drain the greater parts of the city. All abutters are obliged to enter the sewers; and no surface-drainage nor cesspools are allowed.

Nothing left in the Back Bay cars was ever lost; the character of the abutters was guarantee for that, and they were practically the only passengers. The conductors and the drivers were as honest as the passengers, and I could consider myself in the hands of friends.
