Of the Greeks Leo Allatius relates that "on good-friday, while they accompany as it were Christ himself to the tomb, they lead round through the cities and adore the sculptured body of Christ". De consensu utriusque Eccl. lib. 5. c. 15. The Syrians also practise this ceremony, as we learn from documents published by Card. Borgia and Nairon. This rite is called the adoration of the cross.

Contracts perfected by consent, consensu, had reference to sale, hiring; partnership, and mandate, or orders to be carried out by agents. All contracts of sale were good without writing. Acts which caused damage to another opened a new class of cases.

The general communion customary on holy-thursday is prescribed by the English bishop Walter in the 10th century, in the capitulary of Theodulph of Orleans, and by all ancient pontificals and missals, according to Martene T. 3, p. 98. It is practised also by the Greeks, as Leo Allatius testifies. De consensu utriusque Ecclesiæ lib. 3.

"Respondit Blaesus specie recusantis, sed neque eadem adseveratione; et consensu adulantium haud jutus est." And whom were the "sycophants," that is the Senators, flattering? Blaesus? They had no cause to care whether they pleased or displeased him. Tiberius? The Emperor was perfectly indifferent as to which of the two men the Senate selected.

Therefore, when there is any change to be made in the rites of the church, merito fit hoc cum omnium ordinum ecclesiae consensu. Neither was there ever a rightly reformed church which was helped and not hurt by such rites and customs as, to their grief and miscontentment, princes did impose upon them.

In the matter of contracts the Roman law was especially comprehensive, and the laws of France and Scotland are substantially based upon the Roman system. The Institutes of Gaius and Justinian distinguish four sorts of obligations, aut re, aut verbis, aut literis, aut consensu.

Ea igitur auctoritate usus est, de consensu & beneplacito omnium dominorum." p. 556.

Yet we find the most radical of ancient philosophers unconsciously dominated by the argument ex consensu gentium. It is hard to find two more uncompromising thinkers than Zeno and Epicurus.

Had the doctrine of souls no other origin than a false inference from the ordinary phenomena of sleeping and dreaming; were it in no sense an instinctive belief, suggested perhaps and confirmed by supernormal facts, it would still have interest for the anthropologist as one of those almost necessary and universal errors through which the human mind struggles to the truth, such as the errors of astrology or alchemy; but it would in no way contribute to the argument for immortality ex consensu hominum an argument of much avail when it is a case of man's instinctive judgments and primary intuitions, which are God-given, but of ever less value in proportion as there is a question of deductions, inferences, and self-formed judgments.

It is certain that if, as I said, he had died before the divorce was mooted, Henry VIII., like that Roman Emperor said by Tacitus to have been consensu omnium dignus imperii nisi imperasset, would have been considered by posterity as formed by Providence for the conduct of the Reformation, and his loss would have been deplored as a perpetual calamity.
