Another argument against the legislative power in the clergy of England, is, p. viii. that Tacitus telleth us; that in great affairs, the Germans consulted the whole body of the people. "De minoribus rebus principes consultant, de majoribus omnes: Ita tamen, ut ea quoque, quorum penes plebem arbitrium est, apud principes pertractentur." Tacitus de Moribus et Populis Germaniae.
This is a very common and current practice: men presume it lawful enough to say over whatever they hear; to report anything, if they can quote an author for it. "It is not," say they, "my invention; I tell it as I heard it: sit fides penes authorem; let him that informed me undergo the blame if it prove false."
To me it is no less than a matter of admiration how Camero could so far forget himself as to say, that in things pertaining unto religion, dirigere atque disponere penes magistratum est proprie, penes ecclesiasticos ministerium atque executio proprie, telling us further, that the directing and disposing of such things doth then only belong to ecclesiastical persons when the church suffereth persecution, or when the magistrate permitteth that the matter be judged by the church.
In Devonshire and Cornwall it is still considered ominous if a hare crosses a person on the road. See Carew's Survey of Cornwall, p. 22. Mr. Carew had a stone-ring of this kind in his possession, and the person who gave it to him avowed, that "he himself saw a part of the stick sticking in it," but "Penes authorem sit fides," says Mr. Carew. The same superstition still exists in Devonshire.
If the first end of a writer be to be understood, then as his language grows obsolete, his thoughts must grow obscure: multa renascentur quae nunc cecidere; cadentque, quae nunc sunt in honore vocabula, si volet usus, quem penes arbitrium est et jus et norma loquendi.
