Pontius and the Samnites were very angry, and they said it was an unworthy trick; but they did not prevent Posthumius from going safely back to the Romans, who considered him to have quite retrieved his honor. A battle was fought, in which Pontius and 7000 men were forced to lay down their arms and pass under the yoke in their turn.

Observations of this kind having been urged with a warmth proportioned to the atrocity of the conduct which called them forth, by all the most respectable persons, and the senate having passed a decree to the effect that the violence offered was prejudicial to the state, and a precedent of pernicious tendency, immediately the Carvilii, tribunes of the people, giving up the action for a fine, appointed a day on which Posthumius should be tried capitally, and ordered, that unless he gave bail, he should be apprehended by the beadle, and carried to prison.

What Saevius Nicanor, the freedman of Marcus, will deny, The same Saevius, called also Posthumius Marcus, will assert. It is reported, that in consequence of some infamy attached to his character, he retired to Sardinia, and there ended his days. VI. AURELIUS OPILIUS , the freedman of some Epicurean, first taught philosophy, then rhetoric, and last of all, grammar.

And the crimes of this nature were called loesoe majestatis, or high treason. Examples of such as were arraigned or tried for peculation, or defraudation of the commonwealth, were Marcus Curius for intercepting the money of the Samnites, Salinator for the unequal division of spoils to his soldiers, Marcus Posthumius for cheating the commonwealth by a feigned shipwreck.

Here Posthumius fell, fighting with all his might to prevent his being taken. The Boii having cut off his head, carried it and the spoils they stole off his body, in triumph into the most sacred temple they had.

The first and second are very vitious and unworthy of a Prince: in the third, men might well be directed by the examples of those two famous Romans, Regulus and Posthumius.

XX. After this the Sabines invaded the country. Marcus Valerius, Poplicola's brother, and Posthumius Tubertus were then consuls, and Marcus, acting by the advice of Poplicola, who was present, won two great battles, in the second of which he slew thirteen thousand of the enemy without the Romans losing a man.

V. SAEVIUS NICANOR first acquired fame and reputation by his teaching: and, besides, he made commentaries, the greater part of which, however, are said to have been borrowed. He also wrote a satire, in which he informs us that he was a freedman, and had a double cognomen, in the following verses; Saevius Nicanor Marci libertus negabit, Saevius Posthumius idem, sed Marcus, docebit.

What! should an affair of such importance be left to the decision of fools, who, by your sect especially, are called madmen? V. But the Gods have appeared to us, as to Posthumius at the Lake Regillus, and to Vatienus in the Salarian Way: something you mentioned, too, I know not what, of a battle of the Locrians at Sagra.

During the same year, on the ides of July, the temple of Castor was dedicated: it had been vowed during the Latin war in the dictatorship of Posthumius: his son, who was elected duumvir for that special purpose, dedicated it. In that year also the minds of the people were excited by the charms of the agrarian law.
