In some of the German cities, the police have summary jurisdiction in offences musical, and are empowered to demand a certificate, with which every grinder is bound to be furnished, shewing the date of the last tuning of his instrument. If he perpetrate false harmony, and his certificate be run out, he is mulcted in the fine. Such a by-law would be a real bonus in London.
As to the 'majority, the higher classes, the fact that men are often imprisoned for offences political and others which they are proud to suffer for, would always attenuate the ignominy attached to 'imprisonment. And were this the only penalty for all crimes, for first-class misdemeanants and for the most atrocious of criminals alike, the distinction would not be very finely drawn by the interested; at the most, the severest treatment as an alternative to capital punishment would always savour of extenuating circumstances.

And this, but not the increasing punishments, is the way to mend a state: nor can I avoid even questioning the validity of that right which social combinations have assumed of capitally punishing offences of a slight nature.
