Bryce, when reviewing his period of office, mentioned among the details of his policy that he had set his face against jury-packing, and had allowed juries to be chosen perfectly freely. The suspension of the most cherished Common Law rights of the subject from Habeas Corpus downwards has been the inevitable result of a failure to apply democratic principles of government.

The initial fault was attributable to themselves; the jury-packing they complained of was the direct consequence of their own neglect of that essential duty to the State, in the preservation of law and order; and they cannot reasonably or justly shift the onus from themselves upon the Courts.

Jury-packing, forbidden meetings, summary arrests and prosecutions, and police reporters form a discreditable paraphernalia by which to maintain the conduct of government.

Here there was what the newspaper reporters call "sensation in court." What! Had it come to this, that one of the chief institutions of the land a very pillar of the crown and government namely, jury-packing, was to be reflected upon from the bench itself. Monstrous!

Mill's propaganda of Benthamism was for some time obscure. He helped to put together some of Bentham's writings, especially the book upon evidence. He was consulted in regard to all proposed publications, such as the pamphlet upon jury-packing, which Mill desired to publish in spite of Romilly's warning. Mill endeavoured also to disseminate the true faith through various periodicals.

He called in as counsel other lawyers, not so high-minded, so honorable, so highly placed. These little lawyers, shoulder-strikers, bribe-givers and takers, were held in good-humored contempt by the legal lights who employed them. The actual dishonesty was diluted through so many agents that it seemed an almost pure stream of lofty integrity. Ordinary jury-packing was an easy art.

Jury-packing was at an end for the Committee had posted publicly the names of men unfit to judge their fellows, and the courts had wisely failed to place them on venires. "Wait till November," was the watchword. And San Francisco waited. A committee of twenty-one was appointed at a mass meeting shortly before the city election. By this body were selected candidates for all municipal offices.
