In order to evade the law, and so avoid hostile criticism of proposed measures, in order, in fact, to prevent the public and even the Volksraad members from knowing and studying or explaining and digesting the intended legislation, it has become the practice of the Government to propose and rush through the most radical and important enactments in the form of amendments or explanations of existing laws.

It was during a desultory discussion of an ordinary sessions of the Second Volksraad, in which I represented Johannesburg, that one day in September, 1899 to be precise, the afternoon of the 28th the messenger of the House came to me with a note, and whispered, "A message from General Joubert, Sir; it is urgent, and the General says it requires your immediate attention."

Jacob De Villiers had been taken prisoner at Bothaville; but the Council appointed Mr. Hendrik Potgieter, Landdrost of Kroonstad, as Public Prosecutor. Various causes had made it impossible for a legally constituted Volksraad to sit. Some members had, as we called it, "hands-upped"; others had thought that they had done quite enough when they had voted for the war.

And so, without the authorization of the home Government, without the consent of her Majesty's High Commissioner, without the concurrence of the Volksraad, against the will of thirty-nine-fortieths of the people, and in defiance of the protest of their Executive, as Mr.

It is my intention to submit a draft law at the first ordinary session of the Volksraad, whereby a municipality with a Mayor at its head will be appointed for Johannesburg, to whom the whole municipal government of this town will be entrusted. According to all constitutional principles, such a municipal council should be appointed by the election of the inhabitants.

News arrived that troops were marching towards, and massing on, Theophilus sought not to alleviate the anxieties of the Government, nor to quell the now rising alarm amongst the people; he simply sat still and listened, watching the writhings and stragglings of the doomed Volksraad, and awaiting a favourable moment to end its existence.

Moreover, Shepstone received the protests of the Executive Council and of the Volksraad before he issued his proclamation. He had plenty of evidence to show that even if his action was approved by the majority, the Boers were sufficiently divided to demand some delay.

If the Transvaalers had waited, they would have had their Volksraad and all that they wanted. But the British Government had some other local matters to set right, the rooting out of Sekukuni and the breaking of the Zulus, before they would fulfil their pledges. The delay was keenly resented. And we were unfortunate in our choice of Governor.

Each Volksraad appoints, from outside its members, its own secretary on proposal of the Executive Council. Each Volksraad shall have to judge if elections and the qualifications of its own members are according to law. Each Volksraad shall establish its own arrangement of order, shall regulate the process of its transactions, and the power of the Chairman shall be defined by itself.
