Those fierce proconsuls who, at Lyons, Nevers, Nantes, Toulon, had crushed all that they were now forced to venerate by their master, vowed vengeance for their humiliation. They said that this was to be a starting-point for divine right, and the excuse for a new persecution. They felt that they were forging a weapon against themselves, and committing an act of suicide.
There were various laws as to which these governments were allotted to the plunderers. Of these we need only allude to the Leges Semproniæ, or laws proposed B.C. 123, by Caius Sempronius Gracchus, for the distribution of those provinces which were to be enjoyed by Proconsuls.
Now, in this year there came before the Senate a discussion as to the fate of three Proconsuls not as to the primary allocation of provinces to them, but on the question whether they should be continued in the government which they held. Piso was in Macedonia, where he was supposed to have disgraced himself and the Empire which he served.
On the amalgamation of the three Scandinavian monarchies, at the union of Calmar, the allegiance of the people of Iceland was passively transferred to the Danish crown. Ever since that time, Danish proconsuls have administered their government, and Danish restrictions have regulated their trade.
There was a province of urban law and a province of military law, in the latter of which the -provocatio- and other regulations of urban law were not applicable; there were magistrates, such as the proconsuls, who were empowered to discharge functions simply in the latter; but there were, in the strict sense of law, no magistrates with merely jurisdictional, as there were none with merely military, -imperium-. The proconsul was in his province, just like the consul, at once commander-in-chief and supreme judge, and was entitled to send to trial actions not only between non-burgesses and soldiers, but also between one burgess and another.
What official arrangements were made for Proconsuls in regard to money, when in command of a province, we do not know. The amounts allowed were no doubt splendid, but it was not to them that the Roman governor looked as the source of that fortune which he expected to amass. The means of plunder were infinite, but of plunder always subject to the danger of an accusation.
By 370 votes against 20 the senate resolved that the proconsuls of Spain and Gaul should both be called upon to resign their offices; and with boundless joy the good burgesses of Rome heard the glad news of the saving achievement of Curio. Pompeius was thus recalled by the senate no less than Caesar, and while Caesar was ready to comply with the command, Pompeius positively refused obedience.
For Cæsar's military force was like a body that invested him, and he was training it to toil, and making it invincible and formidable, not to oppose the barbarians, but he was disciplining his men in these contests just as if it were merely hunting wild beasts and pursuing them with dogs; and in the meantime he was sending to Rome gold and silver, and the rest of the spoil and wealth which he got in abundance from so many enemies, and by tempting people there with gifts, and assisting ædiles in their expenses, and generals and consuls and their wives, he was gaining over many of them; so that when he had crossed the Alps and was wintering in Luca, there was a great crowd of men and women who vied with one another in their eagerness to visit him, besides two hundred of the Senatorian class, among whom were Pompeius and Crassus; and one hundred and twenty fasces of proconsuls and prætors were seen at Cæsar's doors.
Before the fall of the Roman republic, a usury of the same kind seems to have been common in the provinces, under the ruinous administration of their proconsuls. The virtuous Brutus lent money in Cyprus at eight-and-forty per cent. as we learn from the letters of Cicero.
No direct contact with the Romans had yet taken place, and no one could tell what might come out of this singular state, which reminds us of the early times of Islam; but this much it needed no prophetic gift to foretell, that proconsuls like Antonius and Piso were not called to contend with gods.
