The victory of the so-called democrats at Berne now brought the whole matter to the touch. They appealed to the people in the first Swiss plébiscite, the precursor of the famous referendum.
The wrong done should be righted; why not say that Alsace-Lorraine should be restored? It was not said, because it was not certain that all of the French at that time would fight on indefinitely for reannexation if they were offered a plebiscite; and because it was even less certain whether the English and Italians would fight on. The formula had, therefore, to cover both contingencies.
Cavour imagined that since Napoleon III had obtained the imperial throne by a plebiscite, he would not deny the validity of such a claim in Italy, and forthwith submitted this idea to the Emperor, who was bound to approve of it.
One of the champions of constitutional principles, M. Although Roederer pleaded long and earnestly that Joseph and Louis should come next to the Emperor in the succession, and inserted a clause in the report which he was intrusted to draw up, yet by some skilful artifice this clause was withdrawn from the constitutional act on which the nation was invited to express its opinion: and France assented to a plébiscite for the establishment of the Empire in Napoleon's family, which passed over Joseph and Louis, as well as Lucien and Jerome, and vested the succession in the natural or adopted son of Napoleon, and in the heirs male of Joseph or Louis.
A plebiscite is an enactment of the commonalty, such as was made on the motion of one of their own magistrates, as a tribune. The commonalty differs from the people as a species from its genus; for 'the people' includes the whole aggregate of citizens, among them patricians and senators, while the term 'commonalty' embraces only such citizens as are not patricians or senators.
Fifteen years hence the population of the district will be called upon to indicate by plebiscite their desires as to the future sovereignty of the territory; and, in the event of their electing for union with Germany, Germany is to be entitled to repurchase the mines at a price payable in gold.

This approval of the Führer's decision is even more clear and effective if the plebiscite is concerned with an aim which has already been realized rather than with a mere intention.
