The court then proceeded: "But the nature of this cause is such that none of the considerations hereinbefore set out need be decided," because "the case is a political one of which a court of equity can take no cognizance, and which in the very nature of governmental things must belong to the executive branch of the Government."

And for this purpose it is hereby required that such vessels first enter the port of Cape Francois or Port Republicain, in the said island, and there obtain the passports of the said Government, which shall also be signed by the consul-general or consul of the United States residing at Cape François or Port Republicain, permitting such vessel to go thence to the other ports and places of the said island hereinbefore mentioned and described.
That, in all the changes and innovations hereinbefore described, the pretence used by the said Warren Hastings to recommend and justify the same to the Court of Directors has been, that such changes and innovations would be attended with increase of revenue or diminution of expense to the East India Company; that such pretence, if true, would not have been a justification of such acts; but that such pretence is false and groundless: that during the administration of the said Warren Hastings the territorial revenues have declined; that the charges of collecting the same have greatly increased; and that the said Warren Hastings, by his neglect, mismanagement, and by a direct and intended waste of the Company's property, is chargeable with and answerable for all the said decline of revenue, and all the said increase of expense.
I give and devise the said residue of my estate and effects unto my cousin George Hurst aforesaid and I hereby revoke all wills and codicils made by me at any time heretofore and I appoint Arthur Jellicoe aforesaid to be the executor of this my will jointly with the principal beneficiary and residuary legatee that is to say with the aforesaid Godfrey Bellingham if the conditions set forth hereinbefore in clause 2 shall be duly carried out but with the aforesaid George Hurst if the said conditions in the said clause 2 be not carried out.
