Effort to secure from Colombia the required territorial rights was made in the proposed Hay-Herran treaty, ratified by our Senate, 73 against 5, March 17, 1903, under which we were to pay Colombia, besides an annual rental $10,000,000 for the lease of a belt six miles wide from sea to sea.

The rejection of the Hay-Herran treaty was a great disappointment to the inhabitants of the isthmus, who considered this action a sacrifice of their interests, and some of the foremost citizens conferred with the American agent of the Panama Railroad Company as to the advisability of organizing a revolution.

When we submitted to Colombia the Hay-Herran Treaty, it had been settled that the time for delay, the time for permitting any government of anti-social character, or of imperfect development, to bar the work, had passed.

As long as it was doubtful which route we would decide upon, Colombia extended every promise of friendly cooperation; at the Pan-American Congress in Mexico her delegate joined in the unanimous vote which requested the United States forthwith to build the canal; and at her eager request we negotiated the Hay-Herran Treaty with her, which gave us the right to build the canal across Panama.

In other details, particularly as to the acquisition of the interests of the New Panama Canal Company and the Panama Railway by the United States and the condemnation of private property for the uses of the canal, the stipulations of the Hay-Herran treaty are closely followed, while the compensation to be given for these enlarged grants remains the same, being ten millions of dollars payable on exchange of ratifications; and, beginning nine years from that date, an annual payment of $250,000 during the life of the convention.

In self-defence Roosevelt condemned Colombia's refusal to ratify the Hay-Herran treaty and asserted that no hope remained of getting a satisfactory agreement with that country; that a treaty of 1846 with Colombia justified his intervention; and that our national interests and the interests of the world at large demanded that Colombia no longer prevent the construction of a canal.

President Maroquin, through his Minister, had agreed to the Hay-Herran Treaty in January, 1903. He had the absolute power of an unconstitutional dictator to keep his promise or break it. He determined to break it. To furnish himself an excuse for breaking it he devised the plan of summoning a Congress especially called to reject the canal treaty.

As it was now September, 1903, it did not require the wits of a political bandit to see that, by staving off an agreement with the United States for a few months, Colombia could get possession of property and privileges which the French were selling to the Americans for $40,000,000. So the Colombian Parliament adjourned in October, 1903, without even taking up the Hay-Herran Treaty.

As soon as the Hay-Herran convention was rejected by the Colombian Senate, the advocates of the Nicaragua route began to take courage and to demand that as the "reasonable time" allowed in the Spooner act for the President to acquire the right of way through Panama had expired, it was now his duty to adopt the Nicaragua route.
