These officers so neglected or failed to discharge their duty, that in nearly half the organized counties of the interior no attempt whatever was made to obtain the census or registration; and in the counties lying on the Missouri border, where the pro-slavery party was strong, the work of both was exceedingly imperfect, and in many instances with notorious discrimination against free-State voters.
The Territorial authorities were bent on breaking down, if possible, the passive resistance of the Free-State men. Indictments were found, by a Federal grand jury, against a number of members of the Free-State government for "constructive treason," and they were put under arrest. Indictments were also found against two printing offices in Lawrence, and the principal hotel in the town.
It was called by the old spurious legislature, which represented Missouri, and not Kansas; it was called by a legislature, which, even if not spurious, had no authority for making such a call; it was called under provisions for a census and registry of voters which in more than half the Territory were not complied with; and it was elected by a small proportion of a small minority, the Free-State men and others refusing to enter into a contest under proceedings unauthorized at best, and as they believed illegal.
In a personal note to Governor Hahn at the same time the President said, "I congratulate you on having fixed your name in history as the first Free-State Governor of Louisiana. Now you are about to have a convention which among other things will probably define the elective franchise.
If the Governor harbored any remaining doubt that this bogus Legislature intended to assume and maintain the mastery, it speedily vanished. Their hostility grew open and defiant; they classed him as a free-State man, an "abolitionist," and it became only too evident that he would gradually be shorn of power and degraded from the position of Territorial Executive to that of a mere puppet.
Of the three Governors whom President Pierce appointed, two became active supporters of the free-state party and a third, Governor Shannon, fled from the territory in mortal terror lest he should be slain by members of the party which he had tried to serve.
Struggle for Freedom in Kansas.% We left Kansas in 1856 with a proslavery governor and legislature in actual possession, and a free-state governor, legislature, and senators seeking recognition at Washington. In 1857 there were so many free-state men in Kansas that they elected an antislavery legislature.
This same policy was a few weeks later urged at Topeka, where a mass meeting of the free-State men was called to support and instruct another sitting of the "insurrectionary" free-State Legislature elected under the Topeka Constitution.
No argument would induce the ferryman to explain what the tickets were and where they could be procured. Finally, his patience exhausted, the free-State man suddenly drew from the big pockets of his frock a pair of tremendous pistols, ready cocked, and, holding them full in the face of the surprised ferryman, he said,
The free-state legislature was disposed of by placing in the constitution a provision that all existing laws should remain in force until the election of a Legislature provided for under the constitution. The master-stroke of the convention, however, was the provision for submitting the constitution to the vote of the people.
