But Spinola construed this undertaking as absolute; the Prince as only binding in consequence of, with reference to, and for the duration of; the Treaty of Xanten. The ambassadors and other commissioners, disgusted with the long controversy which ensued, were making up their minds to depart when a courier arrived from Spain, bringing not a ratification but strict prohibition of the treaty.

"Both clauses seem to me perfectly just," said Maitre Mathias. "As to their ratification, Monsieur le comte can, doubtless, come to an understanding with the chancellor, if necessary." Solonet took a pen and added this momentous clause on the margin of the contract.

And be it further enacted, That when the people of any one of said rebel States shall have formed a constitution of government in conformity with the Constitution of the United States in all respects, framed by a convention of delegates elected by the male citizens of said State twenty-one years old and upward, of whatever race, color, or previous condition, who have been resident in said State for one year previous to the day of such election, except such as may be disfranchised for participation in the rebellion, or for felony at common law; and when such constitution shall provide that the elective franchise shall be enjoyed by all such persons as have the qualifications herein stated for electors of delegates; and when such constitution shall be ratified by a majority of the persons voting on the question of ratification who are qualified as electors for delegates, and when such constitution shall have been submitted to Congress for examination and approval, and Congress shall have approved the same; and when said State, by a vote of its legislature elected under said constitution, shall have adopted the amendment to the Constitution of the United States proposed by the Thirty-ninth Congress, and known as article fourteen; and when said article shall have become a part of the Constitution of the United States, said State shall be declared entitled to representation in Congress, and senators and representatives shall be admitted therefrom on their taking the oath prescribed by law; and then and thereafter the preceding sections of this act shall be inoperative in said State: Provided, That no person excluded from the privilege of holding office by said proposed amendment to the Constitution of the United States shall be eligible to election as a member of the convention to frame a constitution for any of said rebel States, nor shall any such person vote for members of such convention.

It will be noticed that it is conditioned upon its ratification by Congress before March 4, 1893. The Secretary of the Interior, who has given the subject very careful thought, recommends the ratification of the agreement, and I am inclined to follow his recommendation.

After the ratification of the certificate, the bankrupt becomes once more a merchant, precisely such as he was before; he receives back his securities, he continues his business, he is not deprived of the power to fail again, on the promised dividend, an additional little failure which often occurs, like the birth of a child nine months after the mother has married her daughter.

The general character of this convention, already signed by the delegates of more than twenty sovereign States, further commends it to the favorable action of the Senate of the United States, whose ratification it still awaits.

Lucien was especially proud of having obtained the cession for which Napoleon was, at that time, very anxious; but both brothers were horrified when Napoleon disclosed how little he cared for constitutional forms by telling them that if the Legislature, as his brothers threatened, would not ratify the treaty, he would do without the ratification; see Iung's Letter, tome ii. p. 128.

There are gentlemen opposing the ratification of this treaty who at that time taunted the Administration of the United States that it had lost touch with its international conscience. They were eager to go in, and now that they have got in, and are caught in the whole network of human conscience, they want to break out and stay out.

I shall demand, besides, that the British ambassador at Constantinople shall formally support my claim to be received as envoy from Greece, and that the whole might of England be pledged to the ratification of my appointment. A very cold but not uncourteous smile was all Atlee's acknowledgment of this speech. 'There are small details which regard my title and the rank that I lay claim to.

We have revoked our ratification of the Treaty commonly known as the Constitution of the United States; a treaty for common defense and general welfare; and we shall be perfectly willing to enter into another Treaty with you, of peace and amity. Reject the olive branch and offer us the sword, and we accept it; we have not the slightest objection.
