But since it must needs happen that mankind fall into troubles and dangers, either undesignedly or intentionally, come let us make a few constitutions concerning them, that so being apprised beforehand what ought to be done, you may have salutary counsels ready when you want them, and may not then be obliged to go to seek what is to be done, and so be unprovided, and fall into dangerous circumstances.

Both had strong and well-turned figures, above the middle height, erect and striking, both had noble features, natural grace and vivacity, constitutions which fitted them for keen enjoyment and zest in life. But from their infancy onward they had been subjected to influences as different as it is possible to imagine.

That the people were the source of all power is proven by their voluntary change of government, against the advice of Samuel, against the oracle, and against the council of elders. We look in vain to the ancient constitutions of Greece and Rome for the wisdom we see in the Mosaic code. Under no ancient government were men so free or the laws so just.

A Constitution, if we are to accept the dogmatic assertions of those who have written with a show of learning on the subject, ought to be evolved rather than established by any parliamentary or despotic act. The history of the world certainly tends to prove that paper Constitutions have not been over-successful in the past.

To understand this amazing period and the spirit which dictated its voluminous, though now forgotten, masterpieces, to analyze it, even to its barbarisms, we need only examine the Constitutions of the University of Paris and the extraordinary scheme of instruction that then obtained. Theology was taught under two faculties that of Theology properly so called, and that of Canon Law.

It advocated the formation of state constitutions on a model far less democratic: first, a lower house, the members of which were to be elected for three years by the people; secondly, an upper house of twenty-four members, to be elected for life by the lower house; thirdly, a governor, to be elected for life by the lower house; fourthly, all judges, all military officers, and all inferior civil ones, to be appointed by the governor.
