Sect. 11. 2d. If the holidays be observed by Formalists only for order and policy, then they must say the church hath power to change them. But this power they take from the church, by saying that they are dedicated and consecrated to those holy uses to which they are applied. Simul Deo dicatum non est ad usus humanos ulterius transferendum, saith one of the popes.

A thorough realist, he never allowed the images of the past or venerable tradition to disturb him; for him nothing was of value in politics but the living present and the law of reason, just as in his character of grammarian he set aside historical and antiquarian research and recognized nothing but on the one hand the living -usus loquendi- and on the other hand the rule of symmetry.

So descriptions, figures, fables, and the rest, must be in all heroic poems; they are the common materials of poetry, furnished from the magazine of nature: every poet hath as much right to them as every man hath to air or water "Quid prohibetis aquas? Usus communis aquarum est." The Poet who borrows nothing from others is yet to be born; he and the Jews' Messias will come together.

This etymology, which associates the word with -arquites-, -milites-, -pedites-, -equites-, -velites- those respectively who go with the bow, in bodies of a thousand, on foot, on horseback, without armour in their mere over-garment may be incorrect, but it is bound up with the Roman conception of a burgess. With this view the -usus loquendi- coincides.

He tells also how he found amongst his father's papers a record of a cure of the gout by a prayer offered to the Virgin at eight in the morning on the first of April, and how he duly put up the prayer and was cured of the gout, but he adds: "Sed in hoc, auxiliis etiam artis usus sum."

Ergo jam dextro Suevici maris littore Aestyorum gentes alluuntur: quibus ritus habitusque Suevorum; lingua Britannicae propior. Matrem deum venerantur: insigne superstitionis, formas aprorum gestant; id pro armis omnique tutela: securum deae cultorem etiam inter hostes praestat. Rarus ferri, frequens fustium usus.

Nec Agricola, prosperitate rerum in vanitatem usus, expeditionem aut victoriam vocabat victos continuisse: ne laureatis quidem gesta prosecutus est: sed ipsa dissimulatione famae famam auxit, aestimantibus, quanta futuri spe tam magna tacuisset.

The designation also of Cisalpine Gaul as -Gallia togata-, which first occurs in Hirtius and not long after disappears again from the ordinary -usus loquendi-, describes this region presumably according to its legal position, in so far as in the epoch from 665 to 705 the great majority of its communities possessed Latin rights.

But when open penance may sometimes work in certain persons more hurt than good, it is commendable and allowable in that case to punish by the purse, and preserve the fame of the party; foreseeing always the money be converted in usus pios et eleemosynam, and thus we think of the thing, and that the offenders should be punished.
