The stat. 1 E. 6. c 12. &5E.6. c. 11. first required two witnesses in treason. The clause against high treason supra, does the same as to high treason; but it seems if 1st and 5th E. 6. are dropped, petty treason will be tried and proved, as at Common law, by one witness. But quære, Lord Coke being contra, whose opinion it is ever dangerous to neglect.

Supra, p. 222. Here we have from the pen of one of the greatest masters the real key of the solution the power, that is, of forcing the mass of the enemy's fleet to escort the transports. Hardy, of course, knew it well from his experience of 1744, and acted accordingly. This case is the more striking, since defence against the threatened invasion was not the whole of the problem he had to solve.

In England, at that time, counsel were not allowed of right to prisoners in cases of felony; but judges were in the habit of straining the law to admit them. Strictly they could only instruct the prisoner in matters of law. The English seem for a long time to have entertained a wholesome distrust of confessions. Blackstone, ubi supra.
