We notice the transaction chiefly as indicating the anomalous situation of the senate. Without power in a proper sense, or no more, however, than the indirect power of wealth, that ancient body retained an immense auctoritas that is, an influence built upon ancient reputation, which, in their case, had the strength of a religious superstition in all Italian minds.

"Revocata in forum fides; submota e foro seditio, ambitio campo, discordia curia: sepultaeque ac situ obsitae, justitia, aequitas, industria, civitati, redditae; accessit magistratibus auctoritas, senatui majestas, judiciis gravitas; compressa theatralis seditio; recte faciendi, omnibus aut incussa voluntas aut imposita necessitas. Honorantur recta, prava puniuntur.

He is too learned to teach, and sometimes too wise even to talk. St. Thomas Aquinas said: "In auctore auctoritas." But there is more than one man at Oxford or Cambridge who is considered an authority because he has never been an author. Against all this mystification both of silence and verbosity Shaw has been a splendid and smashing protest.

If therefore this senate subsequently seemed to the Greeks to be an assembly of kings, this was only what was to be expected; it had in fact been such originally. The Senate and the Resolutions of the Community: -Patrum Auctoritas-

61 Quanta fuit in L. Caecilio Metello, quanta in A. Atilio Calatino!

It was thus on record as an auctoritas senatus, "resolution of the senate," not a senatus consultum. A perfect specimen is given in Letter CCXXIII. This auctoritas was to the effect that no one was to undertake the restoration. M. Cicero presents his compliments to P. Lentulus, proconsul.

CONTRA SENATUS AUCTORITATEM: 'against the expressed wish of the senate' Senatus auctoritas is, strictly speaking, an opinion of the senate not formally embodied in a decree, senatus consultum. Cicero, in Invent. 2, 52 says Flaminius carried his law contra voluntatem omnium optimatium. So in 54 lenientem A. 290, a; G 668; H 549, 1.

But, as to the smaller institutions for education within the pale of dissent, I feel warranted in asserting, from the spirit of the anecdotes which have reached me, that they have not the auctoritas requisite for adequately maintaining their dignity.
