Under the regime of the ghosts the laws were not understood to exist in the nature of things; they were supposed to be irresponsible commands, and these commands were not supposed to rest upon reason; they were simply the product of arbitrary will. These penalties for the violations of those laws were as cruel as the penalties were absurd.

Where individuals shall, within the United States, array themselves in hostility against any of the powers at war, or enter upon military expeditions or enterprises within the jurisdiction of the United States, or usurp and exercise judicial authority within the United States, or where the penalties on violations of the law of nations may have been indistinctly marked, or are inadequate these offenses can not receive too early and close an attention, and require prompt and decisive remedies.

"Resolved, That the establishment of such a militia is at this time peculiarly necessary, by the state of our laws for the protection and defence of the country, some of which have already expired, and others will shortly do so; and that the known remissness of government in calling us together in a legislative capacity, renders it too insecure, in this time of danger and distress, to rely that opportunity will be given of renewing them in general assembly, or making any provision to secure our inestimable rights and liberties from those further violations with which they are threatened.

The grand jury, however, has its plain uses wherever political feeling leads to public disorder. It has also, since the Civil War, been found an effective restraint in some of the Southern States, whether for good or ill, upon prosecutions for violations of certain laws of the United States, brought against members of a community in which those laws were regarded with general disfavor.
