Appeals from the citizens of Murray county brought them no relief and incensed at such outrages, they determined on the first Monday in January last, to turn out and elect such Judges of the Inferior Court and county officers, as would be above the control of Bishop, that he might thereby be prevented from packing such a jury as he chose to try him for his brutal and unconstitutional outrages on their rights.

In view of all the facts, and of its proposed restraint upon the constitutional power of new States besides Missouri, I fully believe the Supreme Court of the United States correctly laid down the law in the Dred Scott decision, declaring the 8th section of the act of 6th March, 1820, being the prohibition of slavery, to be unconstitutional and void, for the simple reason that it was the right of the people of those new States to make a constitution or laws for or against slavery as they saw fit, and not the right of the Congress, which has no power under its own Constitution to make State Constitutions.

For it is the magistracies created and the powers usurped in unconstitutional ways that hurt a republic, not those which conform to ordinary rule; so that in Rome, through the whole period of her history, we never find a dictator who acted otherwise than well for the republic. For which there were the plainest reasons.

On this note she concluded: "We ask the juries to fail to return verdicts of 'guilty' against honest, law-abiding, tax-paying United States citizens for offering their votes at our elections ... We ask the judges to render true and unprejudiced opinions of the law, and wherever there is room for doubt to give its benefit on the side of liberty and equal rights to women, remembering that 'the true rule of interpretation under our national constitution, especially since its amendments, is that anything for human rights is constitutional, everything against human rights unconstitutional. And it is on this line that we propose to fight our battle for the ballot all peaceably, but nevertheless persistently through to complete triumph, when all United States citizens shall be recognized as equals before the law."

Hence the capable magistrate in Rome was ordinarily on a good understanding with his government; in Carthage he was frequently at decided feud with his masters at home, and was forced to resist them by unconstitutional means and to make common cause with the opposing party of reform. In the Treatment of Their Subject

Under these circumstances I have deemed it but fair to inform Congress that whilst I do not consider the bill unconstitutional, this is only because, in my opinion, Congress did not intend by the language which they have employed to interfere with my absolute authority to order Captain Meigs to any other service I might deem expedient.

As is too often the case in high party and revolutionary times, the violent and intriguing were likely to be successful, until it came to be understood that the President would feel it obligatory to place upon the extreme and unconstitutional measures his veto.

The position taken by the Councillors was declared to be unconstitutional, but his Excellency informed them that his estimation of their talents and integrity, as well as his personal regard for them, remained unshaken, and that he was not insensible to the difficulties to which he would be exposed should they deem it necessary to resign.

The court was established, among other purposes, to protect the people from unconstitutional legislation; and if Congress, in the extreme of madness, should attempt thus to invade the sovereignty of a State, it would be within the power, and would be the duty of the court, to check the aggression by declaring such law void.

I do it for the sake of saying that that cannot be so plainly and palpably unconstitutional as to warrant resistance to law, nullification, and revolution, which the honorable gentleman and his friends have heretofore agreed to and acted upon without doubt and without hesitation. Sir, it is no answer to say that the tariff of 1816 was a revenue bill. So are they all revenue bills.
