The Indian-Intercourse Act of 1834, though still nominally in force, is so largely predicated upon the tribal constitution, and assumes so uniformly the national sufficiency of the tribe, that all the life and virtue are taken out of it by the Act of 1871 just cited; and the country is, in effect, left without rule or prescription for the government of Indian affairs.

In new countries it shows clear trace of its descent from the Tribal Herald. A tribe thinly occupying large spaces feels lonely. It desires to hear the roll-call of its members cried often and loudly; to comfort itself with the knowledge that there are companions just below the horizon. It employs, therefore, heralds to name and describe all who pass.

Much is left to the common sense of the Judicial Officers, native customs and religious prejudices receive due consideration, and there is a right of appeal to the Raja. Slavery was in full force when Sir JAMES BROOKE assumed the Government, all captives in the numerous tribal wars and piratical expeditions being kept or sold as slaves.

Magical dangers are supposed to follow on infringement of marriage rules, but, as such results come from violation of any tribal custom, this throws no light on the origin of the feeling of horror in question.

The views now generally accepted as to the origin of society in the family or tribal relations are alike irreconcileable with the selfish psychology from which Hobbes educes his system of morality and with that 'state of nature in which every man was at war with every man' from which he traces the growth of law and government.

It is not that I am totally indifferent to what lies on the platter. Indeed, I have more than a tribal aversion to pork in general, while, on the other hand, I quicken joyfully when noodles are interspersed with bacon. I have a tooth for sweets, too, although I hold it unmanly and deny it as I can.

But at the same time there are many branches of a tribal family, some found as far west as British Burma and all more or less scattered and disorganized as the result of this silent oppression going on through the years, who still are ambitious of preserving their independent isolation, particularly in sparsely-populated spheres far removed from political activity.

The most significant political work achieved by Mahomet, the planting of the federal, and later, the national idea in Arabia in place of the tribal one, was thus inaugurated, and throughout the development of his political power it will be seen that the struggles between himself and the surrounding peoples virtually hinged upon the acceptance or rejection of it.

The new occupiers of Europe evolved the systems of land tenure and soil culture which are still in force with hundreds of millions of men; they worked out their systems of compensation for wrongs, instead of the old tribal blood-revenge; they learned the first rudiments of industry; and while they fortified their villages with palisaded walls, or erected towers and earthen forts whereto to repair in case of a new invasion, they soon abandoned the task of defending these towers and forts to those who made of war a speciality.

Their worship expresses itself naturally in the tribal ritual and the tribal creed. This tribal creed, there can be no doubt, is what they offer us for a talisman to ensure the right ordering of the world. Patriotism and loyalty to hearth and home are passions so strong in humanity that a creed like this, when men are under its influence, is not easily seen to be absurd.
