"The Town Plot not being fixed this Township could not as yet be divided into lots, but is to be as soon as possible: the Proprietors who drew the Township were: John Porteus, Thomas Falconer, sen'r, Esq., John York, Esq., Daniel Robertson, Joseph Peach, Esq., William Parker, Charles Pettit, Ralph Christie, Esq., Daniel Claus, Esq., William Evins, Esq., John Campbell, Esq., Joseph Howard, John Cox, Thomas Falconer, jun'r, John Treby, Esq., James Porteus, Richard Burton, John Livingston, Esq., Samuel Hollandt, Esq., Benjamin Price, Esq.

The whole English law, substantive and adjective, was, in the judgment of all the greatest lawyers, of Holt and Treby, of Maynard and Somers, exactly the same after the Revolution as before it. Some controverted points had been decided according to the sense of the best jurists; and there had been a slight deviation from the ordinary course of succession. This was all; and this was enough.

All men saw the dangerous crisis to which affairs were reduced, and were sensible, that the king could not have put the issue on a cause more unfavorable for himself than that in which he had so imprudently engaged. The lawyers for the bishops were, Sir Robert Sawyer, Sir Francis Pemberton, Pollexfen, Treby, and Sommers.

The twelve, after passing a considerable time in deliberation, informed the Court that one of them entertained doubts. Those doubts were removed by the arguments of Treby and Powell; and a verdict of Guilty was found. The fate of the prisoner remained during sometime in suspense.

But the Aldermen and the other officers of the corporation were in their places. On the following day the magistrates of the City went in state to pay their duty to their deliverer. Their gratitude was eloquently expressed by their Recorder, Sir George Treby. Some princes of the House of Nassau, he said, had been the chief officers of a great republic. Others had worn the imperial crown.

It is true that the judges who laid down this doctrine were removable at the royal pleasure and were eager on all occasions to exalt the royal prerogative. How the question, if it were again raised, would be decided by Holt and Treby was doubtful; and the effect of the doubt was to make the ministers of the Crown indulgent and to make the journalists cautious.

Treby then came to Somers's assistance, and brought forth the Parliament roll of the first year of Henry the Seventh, which repealed the act of Edward the Fourth, and consequently restored the validity of the record of 1399. After a colloquy of several hours the disputants separated. The Lords assembled in their own house.

Address the King to send horse and foot instantly, his own men, men whom he can trust, and to put these people down at once." The men of the long robe caught the flame. "It is not the learning of my profession that is needed here," said Treby. "What is now to be done is to meet force with force, and to maintain in the field what we have done in the senate."

As nothing but presumptions appeared against him, the jury scrupled to bring in a verdict that would affect his life, until they were reviled and reprimanded by judge Treby, then they found him guilty.

They addressed the king against Sir George Jefferies, recorder of London, for his activity in the same cause; and they frightened him into a resignation of his office, in which he was succeeded by Sir George Treby, a great leader of the popular party.
