The positive school of criminology, then, aside from the greater value attributed to daily and systematic measures of social hygiene for the prevention of criminality, comes to radically different conclusions also in the matter of repressive justice.

In a democracy, where the majority rule by the ballot through the forms of law, these physical rebellions and bloody resistances are radically wrong, unconstitutional, and are treason. Better bear the ills you have than fly to those you know not of. Our own Declaration of Independence says that governments long established should not be resisted for trivial causes.

"The result was, that we still have settlements in close proximity to each other, whose peoples use different languages in daily conversation, who vary radically in religious belief, have few natural traits in common, and are almost, if not altogether, 'natural enemies' each to each.

He thinks that short sentences, made as severe as possible, consistent with safety to life, would act as a deterrent more effectually than the long punishments, which are, to a certain degree, mild to all well-conducted prisoners. He also most strongly advocates separation of prisoners; insisting that "the mixing of prisoners together is radically bad, and should at all costs be done away with.

But how is this point established? “We judge from the event itself,” says he; “since God has made it, it was not possible to have made a better.” But this is the language of faith, and not of reason. As an argument addressed to the sceptic, it is radically unsound; for as a medium of proof, it employs the very thing in dispute, namely, that God is infinitely perfect.

Though the Old Testament is not always susceptible of the meaning given to it by Jewish rabbis, it is essentially a Jewish book, and the attempt to find in it a series of prophecies foretelling the coming of Jesus was radically wrong.
