Poligamy was not permitted; and relationship within certain degrees rendered the parties incapable of contracting marriage, and these rules as to forbidden degrees have been substantially adopted in England. Celibacy was discouraged. The law of Augustus Julia et Papia Poppaea contained some seven regulations against it, which were abolished by Constantine.

These laws had sanctions severer than any heretofore known: as their guardians, informers were appointed, who by the Law Papia Poppaea were encouraged with rewards, to watch such as neglected the privileges annexed to marriage and fatherhood, and consequently could claim no legacy or inheritance, the same, as vacant, belonging to the Roman People, who were the public parent.

At a still later period the lex Papia Poppaea augmented the rights of patrons who had more wealthy freedmen. By this it was enacted that, whenever a freedman left property amounting in value to a hundred thousand sesterces and upwards, and not so many as three children, the patron, whether he died testate or intestate, should be entitled to a portion equal to that of a single child.

He once attempted, by his Lex Julia et Papia Poppaea, to counteract the custom which then prevailed, of abstaining from legal marriage and substituting concubinage instead, by which the free population declined; but this attempt to improve the morals of the people met with such opposition from the tribes or centuries, that the next emperor abolished popular assemblies altogether, which Augustus feared to do.

The qualifying of the Law Papia Poppaea was afterwards proposed; a law which, to enforce those of Julius Caesar, Augustus had made when he was old, for punishing celibacy and enriching the Exchequer.
