In July, 1799, the Austro-Russian army captured Mantua and Alessandria; and in the following month Suvoroff gained the decisive victory of Novi and drove the remains of the French forces towards Genoa. The next months were far more favourable to the tricolour flag, for, owing to Austro-Russian jealousies, Masséna was able to gain an important victory at Zurich over a Russian army.

Among these, several are certainly to be found whose superior parts have made them worthy to pierce the crowd and to shake off their native mud; but others again, and by far the greatest number of these 'novi homines', owe their present elevation to shameless intrigues or atrocious crimes. The whole doctrine of that important head of praetorian law, "De novi operis nunciatione," is founded on the principle, that no NEW use should be made of a man's private liberty of operating upon his private property, from whence a detriment may be justly apprehended by his neighbour. This law of denunciation is prospective.

An incident at Novi, between Genoa and Milan, is thus described: "I had strolled into a vineyard behind the town, quite lonely and crowned with one cottage. On one of the secluded paths I found a little girl lying on the grass, with her face turned up to the sun and fast asleep.

Retreat was the common misfortune and necessity. Prilep fell on 16 November; and farther north, as the Serbians retreated into Montenegro and Albania, the Austrians occupied Novi Bazar on 20 November, and Mitrovitza and Prishtina on the 23rd.
